These Terms and Conditions ("Terms") govern the rental of vehicles by D.O.O. "ABRIS MONTENEGRO" (hereinafter "ABRISRENT", "we", "us", or "our") to any individual or entity ("Renter", "you", or "your") who books or uses our services through abrisrent.com or directly with our team. By making a booking you confirm that you have read, understood, and agree to these Terms in full.
1. Definitions
1.1."Vehicle" means any car, SUV, or other motor vehicle provided by ABRISRENT under a rental agreement.
1.2."Rental Period" means the period from the agreed pick-up date and time to the agreed return date and time as specified in the booking confirmation.
1.3."Rental Agreement" means these Terms together with the booking confirmation, pricing details, and any addenda signed at pick-up.
1.4."Security Deposit" means the refundable amount authorised or held on the Renter's payment card at the start of the Rental Period.
1.5."Booking Platform" means the online reservation system operated by Rentsyst Ltd (rentsyst.com) through which bookings on our website are processed. 2. Eligibility & Driver Requirements
2.1.Minimum age. The main driver must be at least 21 years old. Drivers aged 21–24 may be subject to a young driver surcharge depending on the vehicle category.
2.2.Driving licence. The main driver must hold a valid driving licence that has been held for at least 1 (one) full year. The licence must be valid for the vehicle category rented.
2.3.International Driving Permit. If your driving licence is not issued in Latin script (e.g. licences in Arabic, Hebrew, Cyrillic, or Chinese script), you must also present a valid International Driving Permit (IDP) alongside your original licence.
2.4.Identity document. A valid passport or national identity card must be presented at pick-up.
2.5.Additional drivers. Any person who will drive the vehicle must be declared at the time of booking or at pick-up and must meet the same eligibility requirements. Undeclared drivers are not covered by insurance.
2.6.ABRISRENT reserves the right to refuse rental to any person who does not meet the eligibility requirements or whose documents appear invalid or fraudulent.
3. Booking & Payment
3.1.Booking confirmation. A booking is confirmed once you receive a written confirmation from ABRISRENT or via the Booking Platform. We reserve the right to decline any booking at our discretion.
3.2.Payment methods. Payment may be made online by credit or debit card via the Booking Platform, or in cash at the time of pick-up. All prices are quoted in Euros (€) unless otherwise stated.
3.3.Security Deposit. A refundable Security Deposit — typically €200–€300 depending on the vehicle class — will be authorised on the Renter's credit or debit card at pick-up. The deposit is released upon return of the vehicle in satisfactory condition, usually within 3–10 business days depending on the card issuer. Cash deposits may be accepted at our discretion.
3.4.Online booking via Rentsyst. When you book through our website, your reservation is processed by the Booking Platform operated by Rentsyst Ltd. By completing a booking you also agree to Rentsyst's terms of service, available at rentsyst.com/terms. ABRISRENT is not responsible for any technical issues arising from the Booking Platform. 3.5.Pricing. The quoted rental price includes the vehicle, mandatory third-party liability insurance, CDW (see Section 5), and unlimited mileage unless stated otherwise. It does not include fuel, traffic fines, optional extras, cross-border fees, or any amounts arising from damage or loss.
4. Pick-up & Return
4.1.Pick-up. The Renter must be present in person at the agreed pick-up location and time with all required documents (Section 2). If the Renter is more than 3 hours late without prior notice, ABRISRENT may treat the booking as cancelled and the vehicle may be released to another customer.
4.2.Vehicle condition check. At pick-up, both parties will inspect the vehicle together. Any existing damage will be noted on the rental agreement. The Renter is advised to take photographs before driving away. By signing the rental agreement the Renter accepts the vehicle in the recorded condition.
4.3.Fuel. The vehicle is provided with a full tank and must be returned with a full tank. If the vehicle is returned with less fuel, the cost of refuelling plus a €15 service fee will be deducted from the Security Deposit.
4.4.Return time. The vehicle must be returned by the agreed date and time. A grace period of 59 minutes applies. Returns between 1 and 3 hours late will incur a charge of 50% of the daily rate. Returns more than 3 hours late will be charged an additional full day's rental.
4.5.Return condition. The vehicle must be returned in the same clean condition as received. An excessive cleaning fee of up to €50 may be charged if the interior or exterior is returned in an unreasonably dirty state.
4.6.Airport & out-of-hours delivery. We offer meet-and-greet delivery at Tivat Airport, Podgorica Airport, and Bar Port at no extra charge. Out-of-hours pick-up or return (outside 08:00–22:00) must be agreed in advance and may incur a surcharge.
4.7.One-way rentals. One-way rentals between our locations (Tivat, Podgorica, Budva, Kotor, Bar) are available subject to a one-way fee quoted at the time of booking.
5. Insurance & Liability
5.1.Included coverage. All rentals include mandatory third-party liability insurance and Collision Damage Waiver (CDW) as required by Montenegrin law.
5.2.Excess. Standard CDW is subject to an excess (deductible) as indicated at the time of booking. The Renter is liable for damage up to the excess amount. The excess is typically covered by the Security Deposit.
5.3.Full protection upgrade. A zero-excess full protection package is available for an additional fee. Please enquire at the time of booking.
5.4.Exclusions. Insurance coverage does not apply and the Renter bears full liability in the following cases:
- Damage caused while driving under the influence of alcohol, drugs, or any impairing substance;
- Damage caused by an undeclared driver;
- Damage to tyres, wheels, undercarriage, or the roof caused by negligent driving;
- Damage caused by use of the wrong fuel type;
- Theft of the vehicle where the keys were left in or on the vehicle;
- Damage caused during cross-border travel that was not approved in advance;
- Deliberate or reckless damage;
- Damage caused while the vehicle was used in violation of these Terms.
5.5.Personal belongings. ABRISRENT accepts no liability for loss of or damage to personal belongings left in the vehicle.
6. Renter's Obligations & Prohibited Uses
The Renter agrees to:
- Use the vehicle only for lawful purposes and in accordance with the traffic laws of Montenegro and any other country in which the vehicle is used;
- Not drive the vehicle off-road or on surfaces for which it is not designed, unless a specific off-road vehicle has been rented and off-road use has been agreed;
- Not smoke inside the vehicle. A cleaning surcharge of up to €150 will apply if evidence of smoking is found;
- Not transport animals inside the vehicle without prior written permission;
- Not sublet, lend, or otherwise transfer the vehicle to any third party;
- Not use the vehicle for commercial hire (e.g. taxi, rideshare), racing, or driver instruction;
- Not tow any trailer, caravan, or other vehicle;
- Ensure the vehicle is locked and secured whenever left unattended;
- Not modify, tamper with, or attempt to repair the vehicle;
- Comply with all parking regulations and pay any fines incurred during the Rental Period.
7. Accidents, Breakdown & Theft
7.1.In the event of an accident, the Renter must: (i) ensure the safety of all persons involved; (ii) call the police immediately if there are injuries or if the other party disputes fault; (iii) obtain the names, contact details, and insurance information of all other parties; (iv) not admit liability or make any payment to any third party; and (v) notify ABRISRENT as soon as possible by calling or messaging our emergency number.
7.2.Accident report. A written accident report must be completed and signed by the Renter and returned to ABRISRENT before or at the time of vehicle return. Failure to report an accident may result in loss of CDW coverage.
7.3.Breakdown. ABRISRENT provides 24/7 roadside assistance. In the event of a mechanical breakdown not caused by the Renter's negligence, we will arrange assistance and, if necessary, a replacement vehicle as quickly as possible at no additional charge.
7.4.Theft. In the event of vehicle theft, the Renter must report the theft to the local police immediately and provide ABRISRENT with the police report number. The Renter remains liable up to the excess amount under the CDW policy.
7.5.ABRISRENT is not liable for any loss, injury, or inconvenience arising from a breakdown or accident beyond our reasonable control.
8. Cross-Border Travel
8.1.The vehicle may only be taken outside Montenegro with our prior written approval. Cross-border travel is permitted to Albania, Bosnia & Herzegovina, Serbia, and Croatia subject to payment of a cross-border fee and provision of the appropriate documentation.
8.2.Cross-border travel to countries not listed in clause 8.1 is not permitted without explicit written agreement. Unauthorised cross-border use voids CDW coverage and the Renter accepts full liability for any damage, theft, or costs incurred.
8.3.The Renter is responsible for complying with all traffic laws, customs regulations, and entry requirements of any country visited.
9. Cancellations & Modifications
9.1.Cancellation by Renter. Cancellations made more than 48 hours before the scheduled pick-up time are fully refunded. Cancellations made within 48 hours of pick-up are non-refundable. No-shows (failure to appear at pick-up without prior notice) are treated as late cancellations and are non-refundable.
9.2.Modifications. Changes to booking dates, vehicle category, or pick-up/return location can be requested at any time and will be accommodated subject to availability. Price differences will be applied accordingly.
9.3.Cancellation by ABRISRENT. In exceptional circumstances (e.g. force majeure, vehicle damage from a prior rental) we may need to cancel or modify a booking. In such cases we will offer a suitable alternative vehicle or a full refund. ABRISRENT shall not be liable for any consequential losses arising from such cancellation.
9.4.Early returns. Returning the vehicle before the agreed end date does not entitle the Renter to a refund for unused days unless agreed in writing at the time of booking.
10. Extras & Optional Equipment
10.1.Optional extras — including baby seats, booster seats, GPS navigation, and roof racks — are available on request. Extras must be requested at the time of booking or at least 24 hours before pick-up.
10.2.Child seats are fitted and safety-checked by our staff before handover. The Renter is responsible for correct use of child seats during the Rental Period.
10.3.Extras are subject to availability and additional charges as quoted at the time of booking.
11. Traffic Violations & Fines
11.1.The Renter is solely responsible for all traffic violations, parking fines, toll charges, and any other penalties incurred during the Rental Period.
11.2.If ABRISRENT receives a fine or penalty notice relating to the Rental Period after the vehicle has been returned, the amount of the fine plus an administrative handling fee of €25 will be charged to the Renter's payment card on file.
11.3.ABRISRENT may be required by law to disclose the Renter's personal data to the relevant authorities in connection with traffic violations.
12. Personal Data & Privacy
12.1.Personal data collected in connection with your rental is processed in accordance with our Privacy Policy, which forms part of these Terms. 12.2.By making a booking through our website you also consent to the processing of your personal data by Rentsyst Ltd as the Booking Platform operator, in accordance with their Privacy Policy. 13. Limitation of Liability
13.1.ABRISRENT's total liability to the Renter under or in connection with a rental shall not exceed the total rental fees paid by the Renter for that rental.
13.2.ABRISRENT shall not be liable for any indirect, special, consequential, or incidental losses, including loss of profit, loss of enjoyment of holiday, or losses arising from delays caused by circumstances beyond our reasonable control.
13.3.Nothing in these Terms limits or excludes ABRISRENT's liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
14. Governing Law & Disputes
14.1.These Terms and any dispute arising out of or in connection with a rental shall be governed by the laws of Montenegro.
14.2.In the event of a dispute, the parties shall first attempt to resolve the matter amicably by contacting us at abrismne@gmail.com. If a resolution cannot be reached, the dispute shall be submitted to the competent court in Montenegro. 15. Amendments
ABRISRENT reserves the right to update or amend these Terms at any time. The current version will always be available at abrisrent.com/terms. Continued use of our services after any update constitutes acceptance of the revised Terms.
